    DSP's Twitch return - Chat emotes/fanart

I made this advertisement image for the shirts, if you want to use it. Link: https://www.deviantart.com/hermano-carl/art/DSP-Winter-Merch-772353227

I saw on the list of Indie games "Axiom Verge". So I decided to make something for the Prestream, if you want. Link: https://www.deviantart.com/hermano-carl/art/Axiom-Verge-DSP-771934223

    Songs for Stream?

Then yes. If he gets proper authorisation/permission he should be able to use it without a problem. Just like with the copyright free content on Youtube, for example.

    Songs for Stream?

You mean ask other Twitch streamers to see if he could play copyrighted music on stream? He could ask for their experience on it, but the fact is that on "Twitch guidelines" & "Twitch Music FAQ" states clearly that you cannot upload any content that you do not own. In the guideline paragraph also includes "content that you're not authorized to use", and in the title of said paragraph it is written: "Unauthorized Content Sharing". This means that in theory, not only you cannot upload/archive unauthorized material, but you also cannot stream it. Streaming/showing copyrighted material that you do not legally own, without permission, and without being transformative enough, is a copyright violation, so in theory it should not be permitted. You cannot even sing covers with music that you do not own without permission. It says so on their website. @masterxeon2002 said that: "Thousands of streamers big and small stream music as a background noise.", which may very well be true. But if those streamers don't have the ownership/permission to use that music, is technically a copyright violation. Why do they get away with it? Because it's not a big deal, nobody cares that they do and nobody is filling a claim. However if a record company/owner of said copyrighted material decides to intervene, then the streamer gets in trouble. I don't know how much trouble would it be, but nothing good for @Phil if it happens to him. In the end, if Phil decides to play copyrighted music that he does not own without permission, he is leaving himself open to the possibility of someone reporting him for using said content, even if it's not uploaded, just for using it. He could take the risk and assume the consequences, (whichever those are), but I would not recommend it to him.

@masterxeon2002 I believe you cannot stream on Twitch while playing music without the legal ownership of said content. This is displayed on the "Twitch Community Guidelines" page: "Unauthorized Content Sharing and Other Copyright Violations Uploading any content that you do not own, do not have the rights to, or are otherwise not authorized to use, violates our Terms of Service and may make your account liable to DMCA takedowns by third-party rights holders. We do not tolerate, for example: rebroadcasting other Twitch broadcasters' content, playing pirated games, showing third-party movies and television shows, rebroadcasting a sports match, playing on unauthorized private servers, or uploading content from other sites without permission of the copyright owner." The next statement is also displayed on the "Twitch Music FAQ" page: "Q: I love singing covers. Is that okay? A: No, unless you have the necessary rights from the copyright owner to do so. Performing music created by a musician other than yourself may make your content liable to a DMCA takedown request and may make you liable to a claim from the copyright owner." I wouldn't recommend Phil to play copyrighted music, but there is always the possibility of creating a Youtube playlist of copyright-free music, from Youtube itself. There are hundreds if not thousands of those, although they would be random and nothing to do with Phil or gaming.

Hi. I submit this other emote, apart from the previous. Although the "dspYikes112" has 25.6KB.

@Phil Since I know the ban emote could be seen as negative, here is an emote for its replacement, if you want. It's another version of the "take a sip" emote.

The Ban Hammer emote is not a good idea...

@YarlOfOdenheim @Phil Ok, I'll try to make another one for its replacement, since there is still space. As for the idea of the ban hammer, I didn't thought it would be that negative at first, however now I see that depending on perspective it could be seen as bad. (Even though personally I don't find it like being such a big deal).

Hi. I made these other two as well, I believe every preset is in order. Use them if you want.

    DSP's Twitch return - Chat emotes/fanart

Hi. I know there are like 5 or so empty spots for emotes, so I decided to make one. I believe these emotes follow the "Twitch Emoticon Guidelines", as well as the right of using the image, since I took the elements in the image from copyright free webpages, for both commercial and noncommercial uses, without the necessity of attribution, so in theory there should be no problem. As for the specific info regarding the image, the preset is png-24, with transparency, so it should recognize it. And finally, the three sizes for the emoticon are 28x28, 56x56 and 112x112 pixels, however the 112x112 image 's size is at 25kb, and it says on "Twitch Emoticon Guidelines" that it should not exceed 25kb. I'm not sure if that's going to be a problem, specially since I know some people submitted heavier images, but again, I'm not sure. If you want to use the Emoticons, here they are, it's supposed to be like a troll or something getting moderated.

Hi, I submit this image for more variety, even though it's not Halloween themed. Link: https://www.deviantart.com/hermano-carl/art/DSP-Temple-766314954
  12. I have two questions: Do you have a favourite book, and/or which one would you recommend? Will you do another run of the Dark Souls games with a sorcerer build? I know it might be more difficult on some parts, but it's more fun and interesting in my opinion.

    Random Thoughts 4.0

I know exactly what is happening here, because I happened to watch the specific moment in the Prestream that started this conversation. There is no need to get heated up. I believe @TalentedAtLife is refering to the moment when @Phil said "I have to say it, but sometimes these critics, tend to overhype stuff to the point where it's insanely ridiculous.", linking the topic with "Rise of the Tomb Raider" and "Spiderman". And that can be checked with the video "Pre-Stream Sept. 11, 2018: Dragon Quest Returns", exactly at 29:38 minute mark is when the answer starts. Luckily I just remembered this, so there is the answer to this conversation.
