Ask the King Ep. 77 - July 25, 2019

Recommended Posts

This is a lenghty question, but I want to ask about your opinion regarding the intellectual property of transformative content, that I think is interesting enough for this event. For this, I'll give you a preface of a concrete example, that applies to some, if not many games:

In the case of "Sekiro", it shows the 'Activision Software TOS' that you have to agree with, in order to use or access the Program, it basically explains in detail the license that you're buying. This is a limited license that states that you do not have the right to use the software for commercial purposes, you can only do for personal use, amongst other conditions. There is however, a section that explains how you may share 'User Generated Content', but it doesn't cover it for commercial purposes.

So this is my question: since you're technically not buying a license to stream such games and make a profit from it, you're only relying on the concept of "Fair Use" to do it, which application falls into a grey-area, what are the limitations that you think are reasonable when someone appeals to this concept, when trying to defend their content from a copyright claim? Or, in other words, how transformative must content be, to be protected under "Fair Use"?

Do you honestly think old fans like myself and hazzer who choose to leave have as you put it “lost their way” or have become detractors? Personally, I think walking away is the mature thing to do if you decide you don’t like them instead of hating on them.

Also, do you believe you have done nothing wrong despite fans leaving or dropping their Patreon pledge. I get that it’s nice to have an audience that likes you but that shouldn’t undermine the people who are legitimately upset with something.

Thanks and I hope there is no hard feelings.

Hey Phil, first off, I'm happy that you continue to make your content through thick and thin. This is my first question, so bear with me. I'm a big fan of games considered "interactive dramas", games that are heavily story-driven with minimal gameplay. Games like Beyond: Two Souls, Heavy Rain, Life is Strange ect. These games at least in a point in time, and to an extent now, are a decisive issue, and there are two sides to it. The side I'm on, which says that a game is about entertainment, and if it's entertaining, that's all that matters. The other side is that gameplay is the only thing that matters, or at least the most important thing in a game, and if they don't have it, it's not considered a game. One example is the the reviews of Beyond: Two Souls, which were extremely polarizied. What are your thoughts on "interactive dramas" and do you consider them games?

My question: Do you regret not getting a frog themed mascot a few months ago when frogs were white hot in your chat including the new dspFrog emote? I feel like the boring easter bunny mascot that was on clearance sale 2 weeks after Easter was a cop out.

I was sad when you chose to kill Snowball and the Mascot program. I think you should consider Bringing back ALL of the mascots for a special summer mascot couch parade for June and July. Then retire them again for August and bring back a fall theme in September. I think the mascot program could be an interactive element of the stream if you include them in commentary.

Thanks Phil.

Why don't you come up with some sort of back up plan as your pledges and views continue to diminish. Why don't you try to find alternate ways of making money besides streaming games, like a turn key operation or investing in property, ect.?

Samurai Shodown is one of the few fighting games in recent memory that you did not play during its launch week.  How come? When there is a quiet period in the game release schedule would you consider streaming online play sessions of Samurai Shodown, Fighting EX Layer or Mortal Kombat Komplete Edition?

Hey Phil, I was just wondering what your opinion is of people who play a yearly game every year and nothing else. for example, those guys that play the shit out of the new call of duty for a year straight, and then just move right on to the next call of duty without ever playing any other game franchise or genre at all.

I ask because as someone who was like that with street fighter in the 90s and 2000s, you would be able to relate to that mindset.

do you think those people would be better off if they diversified their taste in gaming like you did when you started doing youtube?

thanks

Hey Phil, I have been a fan of yours since 2011. I was wondering with Nintendo Switch Lite coming out in September, do you think the Nintendo 3DS/2DS is finally dying out? Keep up the great work and stay positive and hopefully things will workout for you.

Thanks

What's your opinion on joint bank accounts?

Traditionally, a married couple will merge their income together. However, some couples experience a loss of freedom over their finances. In a 2016 Bank of America survey, 78 percent of couples said they shared at least one bank account.

I believe joint bank accounts promote trust and transparency.

Hopefully, these questions aren't too pointless to answer:

What is your most/least favorite Nintendo franchise, and why?

What do you think about pirating games that cannot be legally purchased - would you consider it fair/ethical?

Do you think formatting your laptop and reinstalling windows 7/8/10 would fix its performance issues?

Which genre of games do you wish you could play more of on your stream, and which games from that genre would you consider playing?

What was your first vehicle, and what's your favorite memory of it?

What was your favorite type of candy growing up?

Do you think you'll ever build (or buy) a new PC so you can both stream and play games on it?

There are some questions for the show. Hopefully, they're not too stupid or haven't already been answered long ago. Just pick and choose the ones you think are good. Cheers Phil and good luck to you on Ask the King!

You mentioned recently on stream about being pulled over by the police, for following a friend home, but didn't want to explain the whole story at the time. I don't recall ever hearing this story, so could you possibly elaborate?

Hey Phil

i have 2 questions which tbh don’t relate a lot to each other but wanted your opinions on these topics

First of all I really feel like I have lost my love for gaming. I have been what many people class as a gamer since 2007 when I was only 6 years old, however I feel that over the past year or 2 I’ve slowly become disinterested in what modern gaming has to offer. Ive switched consoles multiple times during this current generation and feel as though we’ve been promised the world and told everything we wanna hear but these promises never materialise. I mean my xbox one is essentially a YouTube and TV hub and while I have a range of games in my backlog I hardly play anything, I let my sister play Fortnite a lot of the time. I read and watched some videos on how this isn’t down to game devs it’s the publishers forcing devs to add micro dlc in to make them money, for example shado of war, anthem and Destiny. Bungee were popping champagne when they parted ways with activision. My rambling aside what do you think about the current state of gaming and do you think there’s even a point in making next gen consoles if the games we’ll be getting will more than likely be half baked at best and will have microtransactions as a requirement to even save our progress (oh wait Konami already did that with Metal Gear Survive)

My second question is. I’m going to university next September (I live in the UK university is quite different to American collage as you only study one course of your choice at your chosen uni for the whole time you’re there) and I’m liking to study Media Production or a filmmaking degree and the uni im wanting to go to has connections with some of the best media companies and I’ve been debating if I should keep my YouTube channel going while at university as on one hand I feel that I could grow the channel with the connections I’ll gain however with YouTube becoming more drama focused part of my thinks I should abandon it and focus more on building my media presence through my music and presenting. I’m also wanting to host a radio show while at uni too as that is an area I’ll be studying. Do you think youtube is dead enough to abandon it or do you think it will be beneficial to keep on the table?

i know I’ve waffled a lot here but I wanted to get the gaming question in particular off my chest

Hey Phil, if you had the choice of switching from being a gamer youtuber/streamer to a completely different genre of youtuber/streamer what would you be if you were making the same amount of money?

-Yak Almighty

Hey Phil another question, you use to make a lot of lewd jokes when you played video games but not you seem to stay away from stuff like that in your commentary and gameplay, is that from just maturing with age or from getting married or just a bit of both?
